Insurer sued by homeowner who claims home was damaged in fire

BATON ROUGE – An East Baton Rouge alleges her homeowners insurance provider breached contract.

Leisha Clark filed suit against Liberty Mutual Group Incorporated in the 19th Judicial District Court on April 24.

According to the plaintiff’s lawsuit, her home located at 5935 Lanier Dr. in Baton Rouge was damaged by fire. 

The plaintiff allegedly reported all of her lost items and filed claim with the insurer. 

However, the defendant is accused of failing to pay the amount of the claim due to the plaintiff in 30 days after receiving proof of loss, failing to make a written offer to settle with the plaintiff property damage, and breaching its affirmative duty to adjust the claim fairly and promptly.

An unspecified amount in damages is sought for damages, attorney fees and court fees.

The plaintiff is representing herself pro se.

This case has been assigned to Division E Judge William A. Morvant.

Case no. 638,835.
