Man sues maintenance shop after unfinished repair allegedly ruins engine

NEW ORLEANS — A man servicing his car at an oil change shop is suing the shop and its employee, claiming his oil filter was not properly tightened which caused the oil to leak out and ruin the vehicle's engine.

Brandon Ledet filed suit against Take 5 Oil Change, LLC, an unknown employee and their insurer in Orleans Parish Civil District Court on June 1.

On May 31, 2015, the plaintiff claims to have taken his 2004 Dodge Ram 1500 pickup truck to Take 5 with the purpose of having his oil changed which was performed by an unknown employee of Take 5. He claims that, upon paying and leaving the establishment on June 1, the engine of the truck malfunctioned. He states that he then parked the vehicle until he was able to get the vehicle to a mechanic on June 9, at which point he was told the engine had to be rebuilt due to the fact that the oil filter on the 2004 Ram was not tightened properly, causing the oil to leak out and ruin the engine.

The defendant is accused of failing to properly tighten/install the oil filter, failing to inspect the vehicle post-oil change and failing to check the work of its employees so as not to cause damages.

The plaintiff seeks $3,196.35 for the rebuilding of the engine and an unspecified amount for past, present and future mental anguish, inconvenience and aggravation, and cost of past and future motor vehicle rental.

The plaintiff is represented by Michael C. Ginart, Jr., Joyce D. Young, and Nicholas N.S. Cusimano of New Orleans-based Law Offices of Michael C. Ginart, Jr. & Associates.

This case has been assigned to Div. I Judge Piper D. Griffin
