BATON ROUGE – An East Baton Rouge woman is suing a local towing service claiming she injured herself while exiting its truck after her car was towed.
Barbara Murphy filed suit against KCJS Trucking LLC in the 19th Judicial District Court on April 22.
According to court records, the plaintiff lost control of her car and struck a residential structure in March. KCJS Trucking was allegedly summoned to the scene of the accident and hooked the plaintiff's vehicle up to a tow truck. Employees of KCJS Trucking LLC purportedly informed the plaintiff that unless she immediately paid $350 in cash her vehicle would be impounded. Given the circumstances, the plaintiff claims she did not have $350 in her procession and offered a check.
The employees refused but a bystander at the accident insisted on bringing Murphy to the bank right down the street. The KCJS employees agreed and drove the plaintiff to the bank in the area.
The plaintiff states that once the tow truck made it to the bank no one asked her if she needed help getting out of it causing her to fall to the ground in a violent manner. The plaintiff contends that she was severely hurt.
An unspecified amount in damages is sought for body damages, medical expenses and court fees.
