Shopper sues supermarket for damages after alleged fall

NEW ORLEANS – A shopper at a local supermarket is claiming that a leaky freezer caused him to fall and sustain serious injury while buying his groceries.

Scott Ponoroff filed suit against Breaux Mart Supermarkets, Inc. in the Orleans Parish First Civil District Court on June 17.

The plaintiff asserts the incident took place at the supermarket on Magazine Street on Aug.18, 2014. 

The defendant is accused of failing to properly construct and maintain the cooler on the premises to ensure that it did not leak, thus causing his severe injuries. The defendant is further accused of creating an unreasonable risk of harm through its employees by putting a leaking freezer there and allowing the cooler to leak. 

The plaintiff seeks an unspecified amount in damages for past and future medical expenses, past and future lost wages and/or loss of earning capacity, and past and future damages in the form of pain and suffering, mental anguish, emotional distress, loss of love and affection and loss of enjoyment of life.

The plaintiff is represented by Dominick F. Impastato, III and Anthony J. Impastato of New Orleans-based Frischertz, Poulliard, Frischertz, & Impastato.

This case has been assigned to Div. B Judge Regina H. Woods.
