Union National Fire accused of breach of contract by woman burglarized while hospitalized

GRETNA – A homeowner is suing her property insurer claiming it failed to properly pay out a claim after her home was burglarized while she was in the hospital.

Peggy Burns filed suit against Union National Fire Insurance Co. in the 24th Judicial District Court on July 7.

Burns contends that on July 15, 2014 a burglary occurred at her home while she was in the hospital. The plaintiff asserts she did not discover her home had been burglarized until she returned home from the hospital. Burns claims a Jefferson parish Sheriff’s Office report was compiled detailing the burglary which she presented to Union National Fire Insurance Co. which then declined her property damage and loss claim.

The defendant is accused of breach of contract.

An unspecified amount in damages is sought for property damage, economic loss and bad faith.

Burns is represented by attorney Dayal S. Reddy of New Orleans.

The case has been assigned to Division J Judge Stephen C. Grefer.
