Man seeks damages from Breaux Mart after he slips on water

NEW ORLEANS – A man has filed suit after slipping on water while shopping at a New Orleans grocery store.

Scott Ponoroff filed suit against Breaux Mart Supermarkets, Inc. in Orleans Parish Civil District Court.

The suit claims that on Aug. 18, 2014, Ponoroff slipped on the floor of Breaux Mart Supermarket on Magazine Street due to water leaking from a freezer. The plaintiff states that he maintained careful lookout and used adequate care while shopping.

The plaintiff argues that the defendant and their employees created a condition of leaking water and then failed to clean up the hazardous condition after realizing it existed. Furthermore, the plaintiff blames the defendant for failing to maintain the freezer and failing to take care of the unreasonable risk of harm to patrons of the store.

The plaintiff is holding the store liable for negligence arguing its employees created the condition and were constructively or actually aware of the hazard for such an amount of time that would alert a reasonably prudent person in an employee’s position to the existence of such a condition.

The plaintiff seeks damages for medical expenses, lost wages and earning capacity, pain and suffering, emotional distress, loss of love and affection and loss of enjoyment of life.

Ponoroff is represented by Dominick F. Impasto, III and Anthony Impasto of New Orleans-based Frischhertz, Pollard, Frischhertz, & Impasto.

The case is assigned to Division B Judge Judge Regina H. Woods.
