Patten’s Metal Express seeks compensation for allegedly unpaid fees

A metal express company is being sued for alleged unpaid fees.

Patten’s Metal Express LLC and Ronald Wayne Patten filed suit on Sept. 9 against ADCC Metals LLC and H & M Metal Express LLC in the U. S District Court Eastern District of Louisiana, citing violation of the Lanham Act, Louisiana Trademark infringement, Louisiana Unfair Trade Practices Act and open account.

According to the lawsuit, the plaintiffs entered in an agreement with the defendants in 2003, where H & M would purchase metal from the plaintiff and resell it to their customers. In addition, the defendants will be allowed to utilize the PME trademark, trade name and service mark. The plaintiffs contend that from September 2011 until January 2012, the defendants were behind on its payment to PME. The plaintiffs state that the defendants owe $367,938.41.

After reaching out to the defendants numerous times, they still have yet to pay the plaintiff any money on their open account.

The plaintiff is seeking compensation for the full amount of $367,938.41, plus interest, attorney’s fees and collection cost.
