Gretna couple sues claiming man did not disclose termite damage prior to home’s sale

GRETNA – A Gretna couple is suing a man who sold them a home claiming he failed to disclose severe structural defects prior to the home’s sale.

Jennifer and Edward Kass filed suit against Richard Schmitt in the 24th Judicial District Court on Aug. 3.

The plaintiffs claim that on Aug. 29, 2014 they purchased a home from the defendants located at 25 Marie Drive in Gretna for $417,500. The Kasses claim that only after the purchase did they discover the property suffered from structural damage and defects due to termite damage that was not disclosed prior to the sale. The plaintiffs contend Schmitt knew of the defects but failed to disclose them and made misrepresentations about the property's condition.

The defendant is accused of breach of contract.

An unspecified amount in damages is sought for mental anguish, aggravation, inconvenience, bad faith and misrepresentation.

The plaintiffs are represented by Fred L. Herman of the New Orleans-based Law Offices of Fred L. Herman.

The case has been assigned to Division A Judge Raymond S. Steib Jr.

Case no. 752-210.
