NOLA Motorsports Park sued by woman claiming fractured spine in go-kart accident

Gokart

GRETNA – A local racetrack is being sued by a woman who claims she was injured in a go-kart accident.

Diane S. Mitnik filed suit against NOLA Motor Club LLC and NOLA Motorsports Park and Chubb & Son Inc. in the 24th Judicial District Court on Aug. 4.

Mitnik contends that on Aug. 7, 2014 she was attending a function at NOLA Motorsports Park in Avondale and as part of the event took part in a go-kart race. The plaintiff asserts that during the race a go-kart turned in front of her, stopping before she had a chance to avoid colliding with it. Mitnik claims that she ran headfirst into the other go-kart and fell out of the vehicle she was driving and onto the track.

The plaintiff alleges she was attended to by emergency medical technicians and transported to the hospital where it was discovered she had severe personal injuries including fractured spine, a broken rib and several contusions.

The defendant is accused of negligence.

An unspecified amount in damages is sought by the plaintiff.

Mitnik is represented by Michael D. Letourneau of New Orleans-based Murphy, Rogers, Sloss, Gambel & Tompkins.

The case has been assigned to Division D Judge Scott U. Schlegel.

Case no. 752-278.
