Worker sues Quality Energy, alleging unpaid disability benefits

A Terrebonne Parish man is suing his employer, alleging unpaid disability benefits.

Todd M. Babin filed a lawsuit on Oct. 12 in U.S. District Court for the Eastern District of Louisiana against Quality Energy Services Inc., and Standard Insurance Company, alleging unpaid disability benefits during his leave.

According to the complaint, in January 2011, Babin had a work release due to carpal tunnel surgery. He returned to work, the suit says, but a progress note dated in May 2012 stated he was still unable to fully perform his duties.

The lawsuit states Babin underwent elbow surgery July 9, 2012, and although he was able to work for short periods of time, he was disabled from October 2011 through the July 2012 surgery and the following recovery period.

The plaintiff alleges his employer, Quality Energy Services, never fulfilled its part of the application process to Standard Insurance Company, and so he was denied benefits.

Babin seeks unspecified damages and litigation costs along with any other relief deemed appropriate. He is represented by attorney Perry R. Staub Jr. of Taggart Morton in New Orleans.
