A Florida man is suing his former employer and insurance companies, alleging negligence for injuries sustained on the job.
John Bubenik filed a lawsuit on Oct. 16 in U.S. District Court Eastern District of Louisiana against Phoenix International Holdings Inc., ABC Insurance, MC Offshore Petroleum Inc., XYZ Insurance, AAA Company Inc, and AAA Insurance, alleging unsafe conditions leading to an injury to his eye on the job.
According to the complaint, on Oct. 20, 2012, Bubenik sustained an injury to his left eye while on the job, causing an abrasion of the cornea. The suit says he was working an offshore job aboard the Odyssea Courage and was employed by Phoenix International Holdings as a dive supervisor, commercial diver and seaman. He was airlifted to receive medical treatment on Oct. 21, the suit states.
The plaintiff alleges AAA Company was performing water blasting duties at the time, which caused metal particles to fly into his eye, causing the injury. He also says the defendant's lack of care while working contributed to his injury.
Bubenik seeks unspecified damages and litigation costs along with any other relief deemed appropriate. He is represented by attorneys Alejandro J. Rodriguez of Varadi, Hair & Checki, in New Orleans, and Bobby J. Delise and Alton Hall Jr. of Delise & Hall in New Orleans.
