A Louisiana-based contractor is being sued by a construction company over claims of breached contract and various contractual violations.
Eclipse Construction Co. filed a complaint June 1 in U.S. District Court for the Eastern District of Louisiana against Clark/McCarthy Healthcare Partners, alleging breach of contract.
The complaint states that on Feb. 28, 2013, Clark/McCarthy Healthcare Partners entered into a contractual agreement to complete various installations and repairs for the construction on the Southeast Louisiana Veterans Healthcare System Replacement Hospital's roof for $2.2 million.
The claim states that the defendant violated the contract by failing to perform the agreed-upon duties, as well as failing to inform Eclipse of delays. As a result, completion of the contracted duties was delayed, causing Eclipse loss in profits and valuable time.
Eclipse is seeking monetary compensation for all legal expenses, loss of profits and violations. Eclipse is represented by Larry G. Canada and John F. McCormick, of Galloway, Johnson, Tompkins, Burr, and Smith in New Orleans.
