NEW ORLEANS – An insurance company claims that it isn't obligated to pay for damages after a woman fell at a dance recital.
Atain Specialty Insurance Co. filed a complaint on Dec. 15 in the U.S. District Court for the Eastern District of Louisiana against Gayle Bourgeois, MacDonald Dance Studio and Patty Stone, Arts Center Enterprises-New Orleans and the city of New Orleans, alleging negligence.
According to the complaint, Stone was a guest at the Mahalia Jackson Theater in May, and during her visit she went to use the restroom. Upon returning to the theater, however, Stone was unable to see where she was walking due to the lack of lighting on the floor, which caused her to fall, sprain her right ankle and break her left ankle. Stone filed a complaint against the other defendants and demanded restitution for her injuries.
Atain is seeking compensation for the costs of the suit and prays that it is excused from any obligations to the defendants. The company is represented by Sarah Murphy Barro of The Monson Law Firm LLC in Mandeville.
