Bed Bath & Beyond sues Clearview Mall over alleged denial of store remodel

NEW ORLEANS – Retailer Bed Bath & Beyond is suing Metairie-based Richards Clearview in a dispute involving proposed changes to leased property.

Bed Bath & Beyond Inc. filed a lawsuit Jan. 8 in U.S. District Court for the Eastern District of Louisiana against Richards Clearview LLC, alleging breach of a lease agreement and negligence.

According to the complaint, Bed Bath & Beyond leased property for a store at the defendant’s Clearview Mall beginning in 2001. Although the contract allegedly specifies other stores affiliated with BB&B can operate in the leased area under different signage and branding, the suit claims Richards Clearview has refused to authorize alterations needed to divide the leased space into two stores for the Cost Plus World Market and Buy Buy Baby stores.

BB&B seeks an order allowing the proposed changes, plus damages, interest and legal expenses. It is represented by attorneys Matthew A. Woolf and Brian M. Ballay of Baker Donelson Bearman Caldwell & Berkowitz PC in New Orleans.
