NEW ORLEANS – A Louisiana couple say a bus they purchased from Tiffin Motor Homes was defective, and seeks to cancel the sales contract under Louisiana redhibition laws.
Louis J. Gerkin and Sharon M. Gerkin filed a lawsuit Jan. 22 in U.S. District Court for the Eastern District of Louisiana against Tiffin Motor Homes Inc., Dixie Motors LLC and Ally Financial Inc., alleging breach of implied and express warranties and negligent repair.
According to the complaint, the Gerkins purchased the Allegro Bus from Dixie Motors on Sept. 17, 2014, for $311,000, with finance charges expected to bring the final price to more than $400,000. When delivered, the suit says the bus was defective in materials and workmanship, and despite numerous repair attempts under warranty, the defects remain.
The plaintiffs seek a jury trial and damages of more than $400,000, the exact amount to be proven at trial. They are represented by attorney Richard C. Dalton of Mandeville.
