NEW ORLEANS – Shipping company Zheng Yao is being taken to court by an international bank for not allegedly paying its invoices.

ING Bank NV filed a civil lawsuit in the U.S. District Court for the Eastern District Court of Louisiana on Jan. 28 against Zheng Yao Shipping Group LTD, claiming that the defendant has not paid for bunker deliveries.

ING Bank asserts that it is the holder and assignee of certain accounts and assets of O.W. Bunker Far East PTE LTD EP, and Dynamic Oil Trading PTE LTD. As a holder and assignee, ING claims it is entitled to certain accounts receivable and maritime liens corresponding to several vessels which belong to the defendant, who is owned, operated, and managed by FOSCO, a corporation based in Singapore.

ING claims that FOSCO ordered bunkers for its vessels from OW Bunker and Dynamic Oil Trading. However, ING claims that the defendant has yet to pay. The alleged total amount of invoices is $3,422,604.94.

ING is now suing for the cost of the invoice, plus attorney fees, expenses, prejudgment interest, for the court to issue a writ of maritime attachment and garnishment of all property of Zheng Yao Shipping in this district and any other rewards deemed just by the court. It is represented by James D. Bercaw, Robert J. Stefani, Len R. Brignac and Laura E. Avery from King, Krebs & Jurges PLLC in New Orleans.
