St. Bernard Parish man accuses Lumber Liquidators of selling defective flooring

NEW ORLEANS – A resident of St. Bernard Parish is filing suit against Lumber Liquidators over its Chinese flooring allegedly emitting formaldehyde.

Joshua Schneider filed a lawsuit on March 1 in the U.S. District Court for the Eastern District Court of Louisiana against Lumber Liquidators Inc., Lumber Liquidators Leasing LLC, Lumber Liquidators Holding Inc. and Lumber Liquidators Services LLC alleging negligent misrepresentation, redhibition, breach of warranty and unjust enrichment.

Schneider asserts that he bought approximately 598.85 square feet of Morning Star Bamboo laminate flooring from a Lumbar Liquidator store in Harahan on June 1, 2009, for $2,722.11 under the pretense that the flooring met industry and formaldehyde regulations. However, Schneider alleges that the defendants deceived consumers when it was allegedly discovered that their Chinese flooring was not in compliance with regulations and emitted excess levels of formaldehyde that are multiple times the permitted limit, despite the label on the flooring stating “California 93120 Phase 2 Compliant for Formaldehyde.” Schneider claims that defendants continued to deceive consumers by manufacturing, marketing and selling flooring with excess levels of the dangerous gas. He alleges to have been financially damaged by defendants’ acts due to the flooring being markedly less valuable than when he purchased it.

He is now suing for compensatory damages, requesting injunctive relief, and an award for the cost of the suit with pre- and post-judgment interest, attorney fees and any other relief deemed just by the court. He is seeking a jury trial and is represented by Russ M. Herman, Leonard A. Davis and Stephen J. Herman from Herman, Herman & Katz LLC in New Orleans.
