Louisiana woman alleges Nissan Pathfinder is defective

NEW ORLEANS – A Louisiana woman is suing a vehicle manufacturer and a car dealership over claims they sold her a defective vehicle.

Judith Mayeaux filed a lawsuit March 14 in U.S. District Court for the Eastern District of Louisiana against Nissan North America, Eddie Tourelle's Northpark Nissan, and Nissan Motors Acceptance Corp., alleging violations of the Louisiana Redhibition Laws, lender liability, violation of the Magnuson-Moss Warranty Act and negligent repair.

On June 5, 2013, the suit states, Mayeaux purchased a new 2013 Nissan Pathfinder from Northpark Nissan.

The suit states the purchased Pathfinder was defective in materials and workmanship, including air bag defects, transmission defects, exterior cosmetic defects, a door defect and a strut defect.

Mayeaux returned the Pathfinder to the defendants for repairs, but the more significant and dangerous conditions were allegedly not repaired, and the defendants failed to bring the vehicle into conformity with its warranties.

Mayeaux notified the defendants that she wanted a rescission of the sale of the Pathfinder, but the defendants have allegedly failed and refused to buy back the defective vehicle.

Mayeaux seeks actual damages, general and special damages, rescission of the sale, incidental and consequential damages, out-of-pocket damages, any diminution in value of the Pathfinder, past and future economic losses, interests, attorney fees and costs of the suit. Mayeaux is represented by attorney Richard C. Dalton in Mandeville.
