Suit claims Lapalco Plaza violates ADA

NEW ORLEANS – A Jefferson Parish man is suing the owner of the Lapalco Plaza over claims it is not disability-compliant.

Lawrence Fultz filed a lawsuit March 21 in U.S. District Court for the Eastern District of Louisiana against Brackley-Stumpf Properties III LLC, alleging violations of the Americans with Disabilities Act.

The suit states the defendant owns the Lapalco Plaza shopping center in Marrero. Fultz, an amputee who requires a wheelchair or crutches for mobility and who visits Lapalco Plaza to pay his cable bill, allegedly experienced difficulty accessing the property due to architectural barriers.

Specifically, the property allegedly contains accessible-designated parking spaces that are not adjacent to a curb ramp or curb cut into the promenade of the property. Additionally, some accessible-designated parking spaces on the property are allegedly missing the required vertical signage.

Fultz seeks declaratory and injunctive relief, plus attorney fees and costs. He is represented by attorneys Andrew D. Bizer, Garret S. DeReus and Amanda K. Klevorn of The Bizer Law Firm in New Orleans.
