BMI, music groups accuse Covington bar of of copyright violations

NEW ORLEANS – A collection of music corporations is suing a Covington bar, alleging the bar has used their music without permission or proper license.

Broadcast Music Inc, Rick’s Music Inc, Red Sea Songs, Sony/ATV Melody, a Two Tuff Enuff Publishing, EMI Blackwood Music Inc, Henston Publishing, and Music Works filed a lawsuit April 1 in the U.S. District Court for the Eastern District of Louisiana against Daiquiris & Creams of Covington LLC, doing business as Daiquiris & Cream, Faye L. Wagner and Chad L. Nunez, alleging copyright infringements.

According to the complaint, the plaintiffs, since March 2013, have reached out to defendants more than 60 times via phone, mail, and email in an effort to discuss usage of their music and the obligations by the defendants under the Copyright Act to purchase a license for the public performance of musical compositions belonging to the music corporations.

The plaintiffs allege they have sent cease and desist notices to the defendants and there are four willful copyright infringements.

The plaintiffs ask the court to enjoin and restrain the defendants from infringing any further of the copyrighted material, to order statutory damages and court costs, and to award with any other relief deemed just. They are represented by attorneys Mark A. Balkin and Joseph C. Chautin III of Hardy, Carey, Chautin & Balkin LLP in Mandeville.
