NEW ORLEANS — A corporate jet pilot is suing Jefferson Parish businesses, alleging breach of fiduciary duty.
Roseanne M. Currier filed a complaint April 4 in U.S. District Court for the Eastern District of Louisiana against the Entergy Corporation Employee Benefits Committee as administrator for the disability plan for corporate pilots of Entergy Corporation and subsidiaries and the disability plan for corporate pilots of Entergy Corporation and subsidiaries, Entergy Corporation and Entergy Services Inc., alleging they violated the Employee Retirement Income Security Act.
According to the complaint, on April 25, 2014, Currier stopped receiving both her long-term disability benefits and the pilot plan benefits. The plaintiff alleges the defendants abused their discretion in their decision to deny her benefits, abused their discretion by not giving effect to the Q & A document in conjunction with the pilot plan documents, ignored corroborating evidence of her disability from an expert in aerospace medicine and ignored the findings of her medical doctors that she was still unfit to fly.
Currier seeks a trial by jury, compensation the court may deems reasonable, plus benefits due, statutory damages, surcharge, attorney fees, costs and interest for other legal and equitable relief the court deems proper. She is represented by attorney Donald L. Hyatt II in New Orleans.
