Two construction workers allege former employers failed to pay proper wages

NEW ORLEANS — Two construction workers are suing thee companies and two supervisors, alleging alleged unpaid wages and violation of workers compensation law.

Wilson Nunez and Luis Mejia filed a class-action lawsuit, individually and on behalf of other persons similarly situated, April 13 in U.S. District Court for the Eastern District of Louisiana against Orleans Shoring LLC, Santicima Trinidad LLC, La Divina Misericordia LLC, Antonio Nunez and Antonio Nunez Reyes, alleging they violated Fair Labor Standards Act provisions.

According to the complaint, Nunez and Mejia did not receive the rate of time and a half of their regular hourly rate for all hours worked in excess of 40 hours a week. The plaintiffs allege the defendants failed to pay them proper overtime compensation, recklessly disregarded their compensation practices and treated them as exempt from the FLSA’s overtime requirements.

The plaintiffs seek a trial by jury, compensation for unpaid wages, plus interest, liquidated damages, attorney fees and costs, pre-judgment and post-judgment interest and other general and equitable relief the the court deems just. They are represented by attorneys Roberto Luis Costales and Emily A. Westermeier of Costales Law Office in New Orleans, and William H. Beaumont of New Orleans.
