NEW ORLEANS — A Louisiana man is suing the providers of a knee device, alleging a manufacturing defect.
Roger McClain filed a lawsuit April 12, in U.S. District Court for the Eastern District of Louisiana against Zimmer Inc., Zimmer Holdings, Inc., and Zimmer Orthopaedic Surgical Products, Inc., alleging violation of consumer protection laws.
According to the complaint, on April 4, 2015, McClain was implanted with a Zimmer NexGen® knee device on his right knee at North Oaks Medical Center by Dr. Brett Chiasson. As a result of the implantation, the suit says, he required revision surgery leading to personal and economic suffering and loss of services.
The plaintiff alleges the defendants defectively manufactured the Zimmer NexGen® knee device, leading to pain, suffering, emotional distress and economic loss; .
McClain seeks a trial by jury, exemplary damages, attorney fees and costs, and other relief the court deems just. He is represented by attorneys Lawrence Blake Jones, Joshua Rubenstein and Patrick J. Eskew of Scheuermann & Jones LLC in New Orleans.
