Man seeks damages following explosion of tanker that allegedly injured him

GRETNA – A New Orleans Parish man is seeking damages following an incident in which he was allegedly injured due to an explosion of a tanker.

Jovan Lymuel filed a suit against Dupre Logistics LLC and Andrew Carr in the 24th Judicial District Court on April 18.

According to the claim, there was an explosion on Aug. 20, 2013, when a tanker exploded at the Kinder Morgan Delta Terminal in Harvey. The suit states that the tanker was owned by Dupre and operated by Carr. Lymuel, who was working at the location, was allegedly injured in the explosion and sustained injuries to his hearing as well as mental anguish.

The defendant is accused of negligence in failing to perform the transfer of fuel safely, failing to prevent the escape of dangerous vapors, failure to utilize the necessary safety systems and failure to practice a reasonable degree of safety.

The plaintiff is seeking an unspecified amount in damages. He is represented by Jesse R. Elliott of the Law Office of Jesse R. Elliott in New Orleans. The case has been assigned to Division P Judge Lee V. Faulkner Jr.
