LAFAYETTE – A former nurse alleges she is disabled and was wrongfully denied disability benefits.

Rena Pitre filed a complaint on April 26 in the U.S. District Court for the Western District of Louisiana, Lafayette-Opelousas Division against Unum Life Insurance Co. of America alleging that the plan administrator violated the Employee Retirement Income Security Act and the Louisiana Workers' Compensation Act.

According to the complaint, the plaintiff alleges that she has been disabled since March 2013 and has not received her benefits under the long-term disability plan. The plaintiff holds Unum Life Insurance Co. of America responsible because the defendant allegedly abused its discretion by denying to pay her benefits under the long-term disability policy and failed to consider additional medical evidences.

The plaintiff requests a trial by jury and seeks compensation for unpaid benefits, prejudgment interest, reasonable attorney's fees and all court costs. She is represented by Christopher A. Edwards of Edwards Law Firm in Lafayette.
