Guardians accuse trucking company, insurance firms of wrongful death

NEW ORLEANS — Two legal guardians are suing a trucking business and insurance companies, alleging their negligence caused a traffic fatality.

Garrick Rucker, on behalf of his minor children Dylan Rucker, Maleah Rucker, Miles Wood, Cheryl Wood and Grace Wood, filed a lawsuit April 28 in U.S. District Court for the Eastern District of Louisiana against Troy Brigham, Tritex Freighters LLC, Sentry Select Insurance Company and Shelter Mutual Insurance Company, alleging negligence and wrongful death 

According to the complaint, on April 29, 2015, Miles Wood and passenger Jennifer Gibson were traveling in a 2014 Nissan Maxima westbound on U.S. Highway 190 in St. Tammany Parish. At that same time, Brigham was operating a tractor in a private driveway on the side of U.S. 190, when he suddenly attempted to re-enter U.S. 190 and cut off the plaintiff’s vehicle, causing a violent full-speed collision that led to the wrongful death of Jennifer Gibson. 

The plaintiffs allege, Brigham, who was working for Tritex Freighters, recklessly drove the tractor, failed to maintain a proper lookout, failed to take proper safety precautions, failed to maintain control and failed to abide by traffic regulations.

The plaintiffs seek a trial by jury, judgment for all damages plus interest, attorney fees, legal costs and all other relief the court deems appropriate. They are represented by attorney Kenneth C. Bordes of in New Orleans.
