GRETNA – A Jefferson Parish couple is seeking damages following an incident in which the wife was allegedly caused to trip and fall in a parking lot.
Judy Hutchison and Gerald Hutchison filed a suit against Walgreen Louisiana Co. Inc., ABC Corp., ABC Insurance Co. and XYZ Insurance Co. in the 24th Judicial District Court on April 25.
According to the claim, the plaintiffs were guests at the Walgreens store No. 15571 at 4501 Airline Drive in Metairie on May 1, 2015. As Judy Hutchison was walking through the parking lot, the suit states that she stumbled upon a speed bump, which caused her to trip, fall and sustain injuries. The plaintiff allegedly entered the store to seek help, but was not offered any help by the manager. Another employee gave the plaintiff bandages, the suit states. Following the incident, the defendant was obligated to provide footage and photos of the incident to the plaintiff, but the defendant allegedly failed to preserve or provide such evidence.
The defendant is accused of negligence through its failure to inspect the property, maintain the premises and safety codes, repair the premises, provide a safe path through the parking lot, failure to warn of the risk, failure to preserve evidence and destruction of evidence.
The plaintiffs are seeking an unspecified amount in damages. They are represented by Leo J. Palazzo, Jason J. Markey, Michael J. Monistere and Mario A. Arteaga Jr. of the Palazzo Law Firm in Gretna. The case has been assigned to Division K Judge Ellen Shirer Kovach.
