Couple seeks damages alleging husband's condition was misdiagnosed

GRETNA – A Jefferson Parish couple is seeking damages following an incident in which a doctor allegedly failed to diagnose or treat the husband's condition.

Gerald Downes and Patrice Downes filed a suit against Dr. Bryan Bourgeois in the 24th Judicial District Court on April 28.

According to the claim, Gerald Downes visited Bourgeois on May 27, 2013, for medical attention when the incident occurred. The suit states that the plaintiff was experiencing pain in his groin, and the defendant suggested ice and Ibuprofen as a remedy. The plaintiff's symptoms worsened, the suit states, and he sought out aid at the emergency department at Ochsner. The doctors there conducted an ultrasound and discovered that the issue was a testicular torsion, and the suit states that it required the removal of the testicle.

The defendant is accused of breach of standard care through his failure to recognize the plaintiff's condition and failing to take the necessary actions to remedy the situation, in addition to his failure to refer the plaintiff to an emergency surgery facility.

The plaintiffs are seeking an unspecified amount in damages. They are represented by Tracey Rannals Bryan of Rannals Law in New Orleans. The case has been assigned to Division I Judge Nancy A. Miller
