Capital One files suit over allegedly unpaid card balance

GRETNA – Capital One Bank is seeking damages, claiming that a customer failed to make payments on his credit card.

Capital One Bank filed a suit against Michael P. Gordy in the 24th Judicial District Court on May 24.

According to the claim, Capital One Bank and the defendant entered into an agreement in which the defendant agreed to make payments on a credit card issued to him by the plaintiff. Despite his agreement to make regular payments on the card, however, the defendant has accumulated more than $10,000 on the card and has since refused to make payments.

The defendant is accused of failure to make payments on the card and breach of agreement.

The plaintiff is seeking $10,372.21 in damages. The plaintiff is represented by Bradley J. Chauvin, Benjamin G. Lambert, Sarena Y. Gaylor, Remy F. Symons, Elizabeth L. Hyman, Jeremy L. Nusloch, Randall C. Roth and Blake J. Guidry of Couch, Conville and Blitt in New Orleans. The case has been assigned to Division L Judge Donald A. Rowan Jr.
