Woman claims leaky roof at Walmart caused her to fall

GRETNA – A Jefferson Parish woman is suing Walmart following an incident in which she was allegedly caused to slip and fall on an unmarked wet portion of ground.

Lenette K. Gauthier filed a suit against Wal-Mart Louisiana LLC and Wal-Mart Stores Inc. in the 24th Judicial District Court on May 31.

According to the claim, the plaintiff was at the Walmart at 5110 Jefferson Highway in Elmwood on May 25, 2015, when the incident occurred. The suit states that while in the store with her husband and granddaughter, the plaintiff was caused personal injury when she walked down an aisle that allegedly had no markings or warning signs. Upon walking down the aisle, the suit states that the plaintiff was caused to slip and fall due to water that had accumulated due to a leak in the ceiling.

The defendants are accused of negligence in allowing the dangerous condition to exist, failing to properly mark the dangerous situation and failure to warn customers of the danger, as well as overall negligence in the treatment of the situation.

The plaintiff is seeking an unspecified amount in damages. She is represented by Stephen M. Chouest and J. Rand Smith Jr. of the Chouest Law Firm in Metairie. The case has been assigned to Division N Judge Stephen D. Enright Jr.
