LAFAYETTE – A sandblaster alleges he was injured because of exposure to fumes and gases.

Wilson J. Batiste filed a complaint on June 9 in the U.S. District Court for the Western District of Louisiana Lafayette Division against Pharma-Safe Industrial Services Inc. and Enven Energy Ventures LLC alleging that they failed to properly follow safety rules and regulations.

According to the complaint, the plaintiff alleges that on Dec. 13, 2015, together with other Clean Blast LLC personnel, he was directed and instructed by defendants' personnel to enter in one of the platform's supporting legs and descend down to continue sandblasting and painting operations.

The suit states that the plaintiff was later found unconscious and unresponsive and was diagnosed with a hypoxic syncopal episode, caused by fumes on the jobsite. As a result, he claims he suffered injuries and damages, including but not limited to pain and suffering, mental anguish, loss of earnings and medical expenses.

The plaintiff holds Pharma-Safe Industrial Services Inc. and Enven Energy Ventures LLC responsible because the defendants allegedly failed to provide a safe place to work, failed to ensure a safe working environment free of noxious fumes, failed to properly determine the existence of toxic gases, failed to ensure that he was wearing an appropriate respirator and other protective equipment.

The plaintiff requests a trial by jury and seeks judgment against defendant in the sum of not less than $1,000,000, plus legal interest, attorneys' fees and costs and for all other relief which he may be entitled.
