Hotel owner accuses insurer of breaching contract for water damage

NEW ORLEANS — A Jefferson Parish hotel owner is suing a Georgia insurer, alleging it owes more than $344,000. 

Hotel Properties LLC filed a lawsuit June 14 in U.S. District Court for the Eastern District of Louisiana against Westchester Surplus Lines Insurance Company of Roswell, Georgia, alleging breach of contract in violation its statutory obligations.

According to the complaint, on May 15 2015, Hotel Properties sustained extensive damage caused by rain to the interior and the roof of its Best Western Landmark Hotel Tower in Metairie in the total amount of $535,955.16. To date, the defendant has only paid $191,144.85, the suit says. 

The plaintiff alleges the defendant has failed to timely pay the balance due and owed under the terms of the insurance policy in the amount of $344,810.31.

Hotel Properties seeks a trial by jury, judgment for $344,810.31, plus legal interest, attorney fees and costs, plus any other relief to which it is entitled. It is represented by attorneys E. Allen Graves, Jr. David W. Carley, David C. Voss and Lee M. LeBouef of Graves Carley LLP in Baton Rouge.
