NEW ORLEANS — Three cashiers are suing a convenience store operator, alleging failure to pay overtime.
Hassan Mahrous, Hamed Yousef and Murad Mubarak filed a class action lawsuit, individually and on behalf of all others similarly situated, June 14 in U.S. District Court for the Eastern District of Louisiana against LKM Enterprises LLC LKM Convenience LLC and Lenny Motwani, alleging violation of the Fair Labor Standards Act.
According to the complaint, since the plaintiffs began working for the defendants in November 2009, they have worked for approximately 70-80 hours per week but were not paid an overtime premium for all hours worked in excess of 40 per week and were not compensated for their travel time.
The plaintiffs allege the defendants required them to use their personal vehicles for company business, failed to maintain proper time records and failed and refused to pay them overtime compensation at the rate of one and one-half of their regular rate for all hours worked in excess of 40 per week.
The plaintiffs seek a trial by jury, permission for this suit to proceed as a collective action, enjoining the defendants fro continuing their unlawful practices, all unpaid wages, liquidated damages, attorney fees, legal costs, interest and all other relief to which they are entitled.
