Subcontractor alleges Mitsubishi breached contract

LAKE CHARLES — A Calcasieu Parish subcontractor is suing three companies, alleging failure to fulfill the terms of their contract.

CADS Construction LLC filed a complaint June 29 in U.S. District Court for the Western District of Louisiana Lake Charles Division against  Mitsubishi Heavy Industries, Compressor International Corporation and Westlake Petrochemicals LLC, alleging they breached the open account subcontract agreement.

According to the complaint, in February, CADS Construction entered into a subcontracting agreement with Mitsubishi to perform construction services and supply construction materials to the defendant Westlake's project. The suit says the plaintiff suffered financial damages for not receiving full payment or the return of its equipment valued at $112,380.86. 

The plaintiff alleges the defendants failed and refused to pay the amount corresponding to the plaintiff’s work and wrongfully converted the plaintiff’s property to its own use.

CADS Construction seeks trial by jury, all damages, penalties, tort damages, legal interest, costs, attorney fees and all general and equitable relief. It is represented by attorneys Merrick J. Norman and Joseph P. Norman of Norman Business Law Center in Lake Charles.
