Shift manager accuses Popeye's of age discrimination

BATON ROUGE — A Louisiana man is suing a Popeye's restaurant in Baton Rouge, alleging age discrimination.

David Derouen Sr. filed a lawsuit June 28 in U.S. District Court for the Middle District of Louisiana against SRF LLC, doing business as Popeye's, alleging violation of the the Age Discrimination in Employment Act.

According to the complaint, Derouen, 52, who worked as a shift manager at Popeye's July-December 2014, was subjected to harassment and adverse age-related remarks. The suit says he was terminated with no reason Dec. 31, 2015, at the end of an employees’ meeting, and the termination increased his symptoms of colitis. 

Derouen alleges Popeye's terminated his employment in retaliation to his filing an EEOC charge about age discrimination.

Derouen seeks a trial by jury, all legal and equitable relief, including damages for lost wages, liquidated damages, past and future medical costs, attorney fees and legal costs, plus future lost wages and/or front pay. He is represented by attorney J. Courtney Wilson of Metairie.
