Truck driver alleges former employer failed to pay proper overtime

BATON ROUGE — An East Baton Rouge dumpster truck driver is suing is former employer, alleging failure to pay overtime wages.

Eric Isbell filed a lawsuit June 28 in U.S. District Court for the Middle District of Louisiana against Workbox LLC, alleging violation of the Fair Labor Standards Act.

According to the complaint, from October 2014 through February 2015, Isbell regularly worked for more than 40 hours per week as a dumpster truck driver, but was not paid overtime wages. He was only paid his regular hourly rate, the suit says, regardless of the number of hours he worked. 

The plaintiff alleges Workbox failed to pay additional wages at the rate of one and one-half times his regular rate of pay for all hours worked of more than 40 hours per week in accordance with FLSA regulations.

Isbell seeks a trial by jury, unpaid overtime wages, an equal sum as liquidated damages, attorney fees and all legal costs. He is represented by attorneys S. Daniel B. Davis and Randall E. Estes of Estes Davis Law LLC in Baton Rouge.
