Couple claims that a falling item in Kmart caused eye injury to the wife

GRETNA – A couple is seeking damages alleging a woman injured her eye while shopping at a Kmart store.

Joyce Robertson, wife of/and William Robertson, filed a suit against Kmart Corp. in the 24th Judicial District Court on July 5.

According to the claim, the plaintiff was shopping at the Kmart at 2940 Veterans Blvd. in Metairie on Dec. 28, 2015, when the incident occurred. The suit states that while the woman was looking into an unopened box that was on a shelf, an item in the box fell and struck her right eye, causing pain in her eye and requiring subsequent surgery on her eyelid.

The defendant is accused of negligence through failing to secure the contents of the box, allowing a dangerous condition to exist and overall negligence.

The plaintiffs are seeking an unspecified amount in damages. They are represented by Daniel W. Nodurft in Charlotte and J. Van Robichaux, Brian D. Page and Renee Robichaux of the Robichaux Law Firm in New Orleans.

The case has been assigned to Division H Judge Glenn. B. Ansardi.
