AmeriHealth Caritas Louisiana Inc. alleges health care facility was overpaid

BATON ROUGE – A health care provider alleges a Florida-based health care facility that operates a long-term acute care facility in Gonzales was overpaid for its services.

AmeriHealth Caritas Louisiana Inc. filed a complaint in the U.S. District Court for the Middle District of Louisiana against Promise Hospital of Ascension Inc. alleging breach of contract, unjust enrichment and other counts.

According to the complaint, the plaintiff alleges that it overpaid $936,777.31 to the defendant for its services in 2013 and that to date, no action has been made to return the over payment. The plaintiff holds Promise Hospital of Ascension Inc. responsible because the defendant allegedly refused to respond to the demands sent by the plaintiff, insisted that it was paid at the correct rate and refused to provide any documentation to support its position.

The plaintiff requests a trial by jury and seeks for damages in the amount of $936,777.31 and for such further relief to which it may be entitled. It is represented by Robert L. Rieger Jr. TA, Kellen J. Mathews and Patrick L. McCune of Adams and Reese LLP in Baton Rouge.
