M.B. Painting & Maintenance Services claims it was never paid for subcontract work

NEW ORLEANS – A St. Tammany Parish painting and maintenance company alleges it was never paid for work in a public project.

M.B. Painting & Maintenance Services LLC filed a suit against Horus Construction Services Inc.; Skanska Mapp; the state of Louisiana, Office of the Governor, Division of Administration, Office of Facility Planning and Control; Fidelity and Deposit Co. of Maryland; Zurich American Insurance Co.; Federal Insurance Co.; Liberty Mutual Insurance Co.; and The Continental Insurance Co. in the Orleans Parish Civil District Court on July 21.

According to the claim, the plaintiff was subcontracted by the defendants to complete certain work on the Louisiana State University Medical Center project in New Orleans. The suit states that despite the plaintiff completing the work as outlined in the contract, Horus has failed to make payments for the work.

The defendants are accused of breach of contract, breach of payment bonds, breach of the Louisiana Public Works Act, as well as detrimental reliance and unjust enrichment.

The plaintiff is seeking an unspecified amount in damages. It is represented by Kyle Schonekas, Thomas McEachin and Teva Sempel of Schonekas, Evans, McGoey and McEachin in New Orleans.

The case has been assigned to Division F Judge Christopher J. Bruno.
