Shopper alleges she was injured at Walmart due to employee's negligence

NEW ORLEANS – A woman alleges she was struck by a store employee while shopping at Walmart and suffered injuries.

Melva Kay Guidry, wife of, and Kenney Guidry, filed a suit against Walmart Real Estate Business Trust, doing business as New Orleans Walmart No. 3167, John Doe and ABC insurance company in the Orleans Parish Civil District Court on July 18.

According to the claim, Melva Kay Guidry was at the Walmart at 4301 Chef Menteur Highway on July 21, 2015, when the incident occurred. The suit states that the plaintiff was using a handicapped scooter to aid her while shopping when an L-cart, operated by defendant's employee John Doe, struck her scooter, causing injuries to her head and neck.

The defendants are accused of negligence through failing to train employees, failing to keep a lookout for obstacles and failing to operate the L-cart in a safe manner.

The plaintiffs are seeking an unspecified amount in damages. They are represented by Robert Matlock Hearin Jr. of Hearin Law Offices in New Orleans.

The case has been assigned to Division C Judge Sidney H. Cates IV, Chief Judge.
