Woman claims Fidelis terminated her after taking leave for illness

NEW ORLEANS – A woman formerly employed as a house manager for a Mandeville residential care facility alleges she was not reasonably accommodated after returning to work from an illness.

Nancy Wolfe filed a complaint in the U.S. District Court for the Eastern District of Louisiana against Fidelis Care Group and Fidelis Northshore I LLC alleging violation of the Americans with Disabilities Act.

According to the complaint, the plaintiff alleges that in August 2014, she was diagnosed with West Nile virus and meningitis and was unable to work for approximately two months. The suit states she returned to work on a very limited basis beginning Oct. 23, 2014, with a salary reduced by the defendants, and was terminated on Jan. 23, 2015. As a result, she alleges she has sustained damages including, but not limited to, emotional distress, humiliation, embarrassment, medical expenses and lost wages, benefits and retirement.

The plaintiff holds Fidelis Care Group and Fidelis Northshore I LLC responsible because the defendants allegedly failed to offer a reasonable accommodation and illegally retaliated against her for requesting and receiving reasonable accommodation.

The plaintiff requests a trial by jury and seeks judgment against defendants for all sums as are reasonable under the ADA, including back pay, compensatory damages, reinstatement, front pay, attorneys’ fees, costs and expenses and such other relief to which she is entitled.
