Woman alleges Anesthesiology & Pain Consultants terminated her because of disability

LAFAYETTE – A clinic coordinator for a Lafayette facility alleges she was terminated because of her back problems.

Nicole Landry filed a complaint in the U.S. District Court for the Western District of Louisiana, Lafayette Division against Anesthesiology & Pain Consultants LLC alleging that the employer violated the Louisiana Employment Discrimination Law and the Americans with Disabilities Act.

According to the complaint, the plaintiff began working for the defendants in 1999 and started suffering from back problems in 2013. The suit states she underwent surgeries and various treatments and requested for accommodation at work in March 2015, which was allegedly not granted. On Oct. 1, 2015, she was terminated, the suit states, which the plaintiff alleges was because of her disability and in retaliation for requests for accommodation.

The plaintiff holds Anesthesiology & Pain Consultants LLC responsible because the defendant allegedly failed to engage in an interactive process and individualized assessment regarding her medical condition, retaliated against and discharged from employment because of her disability.

The plaintiff requests a trial by jury and seeks judgment against defendants for compensatory damages, pre- and post-judgment interest, costs of suit, attorneys’ fees and expert fees and such other and further relief as may be just and proper. She is represented by Robert B. Landry III of Robert B. Landry III PLC in Baton Rouge and James L. Arruebarrena in New Orleans.
