Landscape worker alleges nursery failed to pay overtime

BATON ROUGE — An Ascension Parish man is suing a landscape business, alleging failure to pay overtime.

Franco Fabian filed a lawsuit Aug. 3 in U.S. District Court for the Middle District of Louisiana against Green Escapes Nursery Inc. and Don Broussard, alleging violation of the Fair Labor Standards Act.

According to the complaint, Faban worked as a landscaper for the defendant between March 2013 and March 2106, regularly and customarily working in excess of 40 hours per week, but he was not paid overtime wages. The suit says he was only paid his regular hourly rate, regardless of the number of hours he worked. 

The plaintiff alleges the defendants failed to pay overtime compensation at the rate of one and one-half times his regular pay for all hours worked in excess of 40 per week as per FLSA regulations.

Fabian seeks a trial by jury, unpaid wages, an equal sum as liquidated damages, attorney fees, interest and all legal costs. He is represented by attorneys Daniel B. Davis and Randall E. Estes of Estes Davis Law LLC in Baton Rouge.
