Man alleges Omaha Life wrongfully denied disability claim

NEW ORLEANS – A Mandeville man formerly employed as an office manager alleges his application for long-term disability benefits was wrongfully denied.

Bernard H. Hagstette filed a complaint in the U.S. District Court for the Eastern District of Louisiana against United of Omaha Life Insurance Co. alleging that the plan administrator violated Employee Retirement Income Security Act.

According to the complaint, the plaintiff applied for long-term disability benefits but the benefits were denied by the defendant on Nov. 16, 2015. The plaintiff alleges that he has suffered economic loss for not receiving his benefits he is entitled under the long-term disability plan. The plaintiff holds United of Omaha Life Insurance Co. responsible because the defendant allegedly has abused its discretion by denying his claim and appeal for the said long term-disability benefits.

The plaintiff requests a trial by jury and seeks judgment against defendant for all benefits due, reasonable attorneys' fees, cost of suit and all other relief as the facts and law may provide. He is represented by James F. Willeford and Reagan L. Toledano of Willeford & Toledano in New Orleans.
