Van owner alleges Chrysler vehicle contained defects, seeks rescission of the sale

NEW ORLEANS – A consumer is seeking the rescission of a sale of a van over allegations the vehicle contained defects.

Sandra Winstead filed a complaint in the U.S. District Court for the Eastern District of Louisiana against FCA US LLC alleging violation of the state's redhibition laws.

According to the complaint, the plaintiff alleges that on April 14, 2011, she purchased a new 2010 Chrysler Town & Country Van from Braun Chrysler-Dodge-Jeep Inc. When delivered, she alleges the van was defective in materials and workmanship, with such defects being discovered within the warranty periods. Such defects allegedly substantially impaired the vehicle's use, value and safety. The plaintiff holds FCA US LLC responsible because the defendant allegedly failed to repair the van so as to bring it into conformity with the warranties and failed and refused to buy back the defective vehicle.

The plaintiff requests a trial by jury and seeks judgment against defendant, rescission of the sale of the subject vehicle, diminution in value attributable to the defects, prejudgment and post-judgment interest, costs of suit and all other relief the court deems appropriate.
