Daiquiri Island Sports Bar & Grill accused of unlawfully broadcasting boxing match

NEW ORLEANS – A New Orleans establishment is accused of broadcasting sports event without authorization to do so.

J&J Sports Productions Inc. filed a complaint on Aug. 29 in the U.S. District Court for the Eastern District of Louisiana against Maria Elsner-Gomez, doing business as Daiquiri Island Sports Bar & Grill, alleging violation of the Cable & Television Consumer Protection and Competition Act.

According to the complaint, the plaintiff alleges that on Sept. 12, 2015, the defendant unlawfully intercepted a boxing pay-per-view event. The plaintiff holds Maria Elsner-Gomez responsible because the defendant allegedly failed to prevent the unlawful interception, broadcasting and/or publishing of plaintiff's program on her premises and had a direct commercial interest and financial gain in the unlawful interception.

The plaintiff requests a trial by jury and seeks compensation for statutory damages in the amount of $170,000, attorney’s fees, costs of suit such other and further relief as the court may deem just and proper. It is represented by Ronnie J. Berthelot of The Berthelot Law Firm LLC in Baton Rouge.
