Man says doctor at federally funded Teche Action Clinic was negligent

NEW ORLEANS — A former medical patient from Houma is suing the federal government, alleging negligence in health care.

Erick Wolfertz filed a complaint on Sept. 7 in the U.S. District Court for the Eastern District of Louisiana against the United States of America, alleging that government employee Dr. Cara Morgan of the federally funded Teche Action Clinic breached her duty to provide proper medical care.

According to the complaint, the plaintiff alleges that as a result of Morgan's actions, he has sustained physical pain and suffering, mental anguish, medical expenses, loss of enjoyment of life, loss of earning capacity and other damages which may be proven at trial. The plaintiff holds the United States of America responsible because Morgan allegedly failed to timely refer him to Tulane Medical Center for a spine disorder, leading to the plaintiff's present state of needing a wheelchair for mobility.

The plaintiff requests a trial by jury and seeks judgment against the defendant for all amounts reasonable under the premises, plus interest, costs of these proceedings, and for all equitable relief. He is represented by Michael J. Samanie and Stephen S. Stipelcovich of Samanie & Stipelcovich in Houma.
