LAFAYETTE — A Texas horse breeder is suing Greg McBride, Metal Buildings by Mac LLC, S&S Steel Buildings Inc., E. Smith Plumbing Service Inc. and Roy Bergis Smith, citing alleged breach of contract and unfair or deceptive acts or practices.
Janet Jeanes filed a complaint on Sept. 6 in the U.S. District Court for the Western District of Louisiana against the defendants, alleging that they failed to comply with their obligations when they defectively designed and constructed a barn.
According to the complaint, the plaintiff alleges that she has suffered, or will suffer, non-exclusive damages because she cannot occupy the newly constructed barn, for costs associated with the remediation and repair of the barn and business losses resulting from her inability to use the barn for her horse-breeding and racing business. The plaintiff holds the defendants responsible because they defendants allegedly failed to exercise the requisite degree of care and skill in constructing the barn and failed to schedule timely inspections as required by the Rapides Area Planning Commission.
The plaintiff requests a trial by jury and seeks rescission of the contract, including an award of the return of the contract price plus the cost of restoration, legal interest, attorney fees, costs and other additional or alternative relief.
