City of Kenner, other parties accused of violating process server's civil rights

NEW ORLEANS — A special process server is suing a city and various officials over an alleged violation of civil rights.

David Cook of Gretna is suing the City of Kenner, Kenner Police Department, Immanuel Cohen, Kenner City Attorney's Office, Christopher Weddle, Arthur Dupre Jr. and Magistrate Judge Bruce Lizana, government units and employees, alleging that his civil rights were violated.

Cook filed a complaint on Sept. 9 in the U.S. District Court for the Eastern District of Louisiana against the defendants, alleging that they violated his constitutional rights to equal protection. According to the complaint, the plaintiff alleges that he was illegally arrested, booked, processed, detained and charged with aggravated assault. The plaintiff holds the defendants responsible because they allegedly breached his constitutional rights to liberty, right to property and due process.

The plaintiff requests a trial by jury and seeks judgment against the defendants, jointly and severally, for all damages, plus legal interest, attorney's fees, costs and expenses and all other equitable releif. He is represented by Joseph G. Albe, Jr. of Albe Law Firm LLC in New Orleans.
