Parents allege minor child was injured in a fall because of pothole

NEW ORLEANS – A Jefferson Parish couple allege their minor child was injured in a fall caused by a pothole.

Vadym Rusnak and Oksna Nimkevyah, both individually and on behalf of their minor child, filed a suit against the city of New Orleans and Sewage and Water Board of New Orleans in the Orleans Parish Civil District Court on Sept. 21.

According to the claim, the plaintiffs' son was injured on Feb. 25 when the incident took place. The suit states that the mother was caused to trip and fall on a concrete pothole while carrying the child. The fall caused the child injuries and was due to the defendants' negligence, the suit states.

The defendants are accused of negligence through failure to repair the pothole, failing to provide warnings of the situation and overall negligence in maintenance of the premises.

The plaintiff is seeking an unspecified amount in damages. The plaintiff is represented by Brian King, Jason F. Giles, Anthony J. Milazzo and Michael J. Simonson of the King Firm in New Orleans.

The case has been assigned to Division N Judge Ethel S. Julien.
